Housing Protests: Concerns Raised Regarding Police Intervention

Telma Barbosa Vieira, lawyer at Dower Law Firm, appeared on RTP to analyse recent police interventions during demonstrations advocating for the right to housing held in Lisbon and Porto, while providing clarification on the key legal issues surrounding the exercise of the rights to assembly and peaceful protest.

During the interview, it was highlighted that, although the right to demonstrate is constitutionally protected, its exercise is subject to legal requirements designed to safeguard public order and safety. In this context, it was addressed the legal framework governing police intervention, the circumstances that may justify the dispersal of demonstrations, and the potential criminal consequences of failing to comply with lawful orders issued by the authorities.

The conduct of law enforcement authorities and the legal safeguards afforded to demonstrators were also discussed. Telma Barbosa Vieira emphasised the importance of establishing, through the appropriate legal mechanisms, whether there were any instances of excessive use of force, distinguishing the legitimacy of police intervention from the manner in which such intervention is carried out.

The lawyer also examined the judicial procedures applicable to detained demonstrators, including summary proceedings and the possibility of provisional suspension of criminal proceedings, a mechanism provided for under Portuguese criminal law which, where the relevant legal requirements are met, may prevent a case from proceeding to trial while promoting the prevention of reoffending.

This intervention reinforced the importance of balancing the exercise of fundamental rights with compliance with the law, ensuring both a proportionate response by public authorities and respect for citizens’ legal guarantees.
